Legal
Privacy, in plain language.
The short version: we collect almost nothing, we sell nothing, and everything we do collect is listed below.
Who we are
This Privacy Policy is issued on behalf of Chirp USA, LLC, 336 E. College Ave, Suite 301, Tallahassee, FL 32301, USA, which operates NoClone ("NoClone", "we", "us", "our"). For the processing described here, we are the controller. We are a US company, so your data is processed in the United States. We process personal data in accordance with applicable law, including Regulation (EU) 2016/679 (the General Data Protection Regulation, "GDPR") where it applies to you.
If you have a question about privacy, or want to exercise any of the rights described below, write to [email protected].
What this policy covers
This policy covers the NoClone website at noclone.marketing and the waitlist you can join on it. NoClone the product has not launched yet; when it does, the personal data processed inside the application will be described in a policy you can read before you create an account.
Our website may link to other websites and services we do not control. Following those links may allow the operators of those sites to collect data about you. We are not responsible for their privacy practices, and we encourage you to read the privacy policy of any site you visit.
The waitlist
When you join the waitlist we ask for one thing: your email address. We store it, together with the language you signed up in so that launch news reaches you in the right language, and the two-letter country code our network provider derives from your connection. We do not ask for your name, your company, or anything else.
We use it for exactly one purpose: to tell you when NoClone opens, and to send you the early-access pricing that goes with it. The legal basis is your consent, Art. 6(1)(a) GDPR, given when you submit the form. You can withdraw it at any time by writing to [email protected], and every email we send includes an unsubscribe link.
The list is stored in Cloudflare D1, a database run by Cloudflare on our behalf under a data processing agreement. It is not shared with anyone else, it is not sold, and it is not used to build a profile of you.
Connection data
When you visit noclone.marketing, our infrastructure automatically receives technical data that your browser sends: your IP address, the date and time of the request, the page requested, the referring page, and information about your browser and operating system. This is needed to deliver the site securely and to detect and defend against abuse. The legal basis is our legitimate interest in operating a secure website, Art. 6(1)(f) GDPR.
The site is served through Cloudflare, which acts as a content delivery network and protects it against attacks. Cloudflare processes connection data, including your IP address, on our behalf under a data processing agreement.
Analytics without cookies
We measure site traffic with Cloudflare Web Analytics. It sets no cookies, stores no personal data, and cannot identify you or follow you between sites — we see aggregate page counts, not people. That is also why this site shows no cookie banner: there is nothing to consent to.
The waitlist form is protected by Cloudflare Turnstile, which checks that submissions come from a person rather than a script without tracking you across the web.
What we never do
We do not sell or share your email address. We do not run advertising trackers. We do not build profiles of visitors. We do not set marketing or analytics cookies. We do not use your data to train models, and we make no decisions about you by automated means.
Who we share data with
We use service providers who process personal data on our instructions under data processing agreements: Cloudflare, for hosting, content delivery, security, the waitlist database and analytics. We disclose data to anyone else only where the law requires it or where there is another valid legal basis. We do not sell personal data.
International transfers
We are based in the United States, and personal data may be processed there and in other countries where our service providers operate. Where data is transferred out of the European Economic Area to a country without an adequacy decision under Art. 45 GDPR, we put appropriate safeguards in place under Art. 46 GDPR, such as the European Commission's standard contractual clauses together with any additional measures needed to protect the data.
Data security
We use appropriate technical and organisational measures to protect personal data against loss, misuse, unauthorised access, alteration and disclosure. Traffic between your browser and our services is encrypted in transit. Access to the waitlist is limited to the people who need it, and they are bound by confidentiality. We have procedures for handling suspected data breaches and will notify you and the relevant regulator where the law requires.
How long we keep data
We keep your email address until NoClone launches and the launch announcement has been sent, or until you ask us to remove it — whichever comes first. After that the waitlist is deleted. Connection data held for security purposes is kept for a short period and then discarded or aggregated.
Your rights
Subject to the conditions of applicable law, you have the right to:
- confirmation of whether we process personal data about you, and access to a copy of it (Art. 15 GDPR);
- correction of inaccurate personal data (Art. 16 GDPR);
- erasure of your personal data (Art. 17 GDPR);
- restriction of processing (Art. 18 GDPR);
- portability of the data you provided to us, in a machine-readable format (Art. 20 GDPR);
- object to processing carried out on the basis of legitimate interests (Art. 21(1) GDPR);
- object to direct marketing at any time, without giving a reason (Art. 21(2) GDPR);
- withdraw consent at any time, with effect for the future (Art. 7(3) GDPR);
- lodge a complaint with a data protection supervisory authority (Art. 77 GDPR).
Children
NoClone is a business tool and is not directed at children. We do not knowingly collect personal data from children. If you believe a child has provided us with personal data, contact us and we will delete it.
Changes to this policy
Changes in the law, in our services, or in the technology we use may require changes to this policy. The current version is always published on this page, and material changes are announced to the waitlist before they take effect.
